13 Data Protection Under Indian Law
For users resident in India, this section sets out our compliance with the Digital Personal Data Protection Act, 2023 (the "DPDP Act 2023") and the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021 (the "IT Rules 2021"). This section supplements - and where applicable supersedes - the GDPR/CCPA-aligned rights described above.
13.1 Applicability
The DPDP Act 2023 applies to the processing of digital personal data within India and to processing outside India when the processing is in connection with offering goods or services to Data Principals (users) in India. As an intermediary publishing user-generated content, we also operate within the framework of the IT Rules 2021.
13.2 Your Rights as a Data Principal (DPDP Act 2023, Sections 11-15)
The DPDP Act 2023 grants Data Principals the following rights, set out in Sections 11 to 15 of the Act:
- Section 11 - Right to access information about personal data: a summary of the personal data being processed, the processing activities, and the identities of any other Data Fiduciaries / Data Processors with whom that data has been shared.
- Section 12 - Right to correction and erasure: correction of inaccurate or misleading data, completion of incomplete data, updating, and erasure of personal data that is no longer necessary for the purpose for which it was processed.
- Section 13 - Right of grievance redressal: a readily available means of grievance redressal (see §13.4 below).
- Section 14 - Right to nominate: the right to nominate any other individual to exercise these rights in the event of death or incapacity.
- Section 15 - Duties of Data Principal: a Data Principal shall comply with applicable laws when exercising these rights, shall not impersonate another person, and shall furnish only verifiably authentic information.
13.3 Lawful Basis & Consent
We process your personal data only on a lawful basis recognised by the DPDP Act 2023 - typically your free, specific, informed, unconditional and unambiguous consent obtained at registration, or for certain "legitimate uses" expressly permitted by the Act. You have the right to withdraw consent at any time without affecting the lawfulness of processing carried out before withdrawal. Withdrawal of consent for essential matchmaking processing may result in account suspension or deletion.
13.4 Grievance Officer (DPDP Act 2023 §13 & IT Rules 2021 Rule 3(1)(d))
In compliance with Section 13 of the DPDP Act 2023 and Rule 3(1)(d) of the IT Rules 2021, we have designated a Grievance Officer to receive and resolve complaints relating to (a) the processing of personal data and (b) any content hosted on or transmitted through our platform that is alleged to be in violation of applicable Indian law:
